Your remortgage solicitor will begin by verifying your identity and carrying out anti-money laundering checks. If you’re contributing your own funds towards the existing mortgage, they’ll also confirm the source of those funds. These checks apply to everyone named on the mortgage and property title.
Your solicitor will obtain the Official Copies from the Land Registry to confirm ownership and review any legal charges registered against the property.
If there are additional secured loans, a deed of postponement may be required before completion. For leasehold properties, your solicitor will also ensure the lease meets your new lender’s requirements.
At this stage, property searches (or a search indemnity policy, if acceptable to your lender) will also be arranged.
Your solicitor will review your lender’s formal mortgage offer to ensure all conditions can be satisfied.
They will also request a Redemption Statement from your current lender to confirm the exact amount required to repay your existing mortgage.
Before completion, your solicitor will carry out final checks, including:
- An Official Search with Priority (OS1) to protect the title
- Bankruptcy searches against all parties
Once satisfied, they will submit the Certificate of Title to your new lender and request the release of funds.
On completion day, your solicitor will:
- Repay your existing mortgage
- Settle legal fees and disbursements
- Transfer any remaining funds to you (if you are raising additional capital)
After completion, they will register your new mortgage with the Land Registry.

Conveyancing for remortgage is the legal process of transferring your mortgage from one lender to another without selling your property. A remortgage solicitor handles the legal work required by your new lender, including reviewing the mortgage offer, carrying out necessary checks, redeeming your existing mortgage and registering the new charge with HM Land Registry.
Yes, in most cases your new lender will require a remortgage solicitor to act on their behalf. Even though you already own the property, there is still legal work involved in removing your old lender’s charge and registering the new one. Your solicitor ensures the process is completed correctly and that funds are transferred securely.
Conveyancing for remortgage typically takes between 2 to 6 weeks, depending on how quickly your lender issues the mortgage offer and whether any additional legal checks are required. If the property is leasehold or there are title issues to resolve, the process can take longer.
The cost of a remortgage solicitor varies depending on the complexity of the transaction and whether the property is freehold or leasehold. Many firms offer fixed-fee conveyancing for remortgage, so you know exactly what you’ll pay from the outset. You should also check whether your lender offers a free legal package as part of your remortgage deal.
